Terms & Conditions
These Terms & Conditions (“Terms”) form a legally binding agreement between you and PT Kerja Handal Nusantara (“Fasgrade”, “we”, “us”), governing your access to and use of the Fasgrade web app, mobile applications, embedded widgets, APIs, and related services (collectively, the “Services”).
1. Definitions
- Fasgrade the simulation-based assessment platform operated by PT Kerja Handal Nusantara.
- User any person or entity that accesses or uses the Services.
- Participant a User who takes assessments and manages a public talent profile.
- Employer a User who uses the Services to invite, screen, or hire participants.
- Content any text, image, video, document, response, or data submitted to or generated by the Services.
- Account the credentials (email, password, or SSO identity) you use to access the Services.
2. Eligibility
- You must be at least 13 years old (or the minimum legal age in your jurisdiction). Some features require users to be at least 18.
- If you register on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
- You may not use the Services if you are barred from doing so under applicable laws, including sanctions and export-control regulations.
3. Accounts & security
- You must provide accurate, current, and complete information when creating an Account and keep it up to date.
- You are responsible for all activity that occurs under your Account, including safeguarding your password and SSO tokens.
- Notify us immediately at business@fasgrade.com if you suspect unauthorized use of your Account.
- We may suspend or terminate Accounts that violate these Terms, applicable law, or compromise platform integrity.
4. The Services
Fasgrade provides, among other features:
- Assessments for roles such as Sales, Content, and Customer Success.
- Grade ladder & Grade Points (GP) system to recognize verified competency.
- Reviewer tools for calibrated human scoring and feedback.
- Employer dashboards, ATS integrations, embeddable widgets, and APIs.
We may add, change, or discontinue parts of the Services at any time. Where changes materially reduce paid functionality, we will provide reasonable notice and, where appropriate, a pro-rata refund.
5. Participant obligations
- Submit only your own, truthful responses. Cheating, impersonation, or any form of test-fraud is grounds for permanent ban.
- Do not share, leak, or distribute assessment items, prompts, or sample answers.
- Comply with the time limits, recording requirements, and proctoring rules of each assessment.
- Treat reviewers and other users with respect.
6. Employer obligations
- Use the Services lawfully, including all applicable employment and anti-discrimination laws in your jurisdiction (e.g., EEOC, GDPR, Indonesia's UU Ketenagakerjaan).
- Do not require participants to pay fees as a condition of taking an assessment.
- Use participant data only for the hiring purpose for which it was provided. Do not sell, share, or otherwise misuse participant data.
- You are solely responsible for hiring decisions and the employment relationship with participants; Fasgrade is not a party to that relationship.
7. Prohibited use
You agree not to:
- Upload content that is illegal, infringing, hateful, sexually explicit, or otherwise harmful.
- Scrape, reverse-engineer, decompile, or attempt to bypass any security or rate limit of the Services.
- Use the Services for fraud, money laundering, or any criminal activity.
- Distribute viruses, malware, or otherwise interfere with the operation of the Services.
- Impersonate another person or misrepresent your affiliation with any organization.
- Send spam or unsolicited marketing through the Services.
8. Payments, billing & refunds
- Core participant assessments are free. Premium add-ons and employer plans are subject to the pricing displayed at checkout.
- Payments are processed by PCI-compliant third-party processors; we do not store full card numbers.
- Subscriptions renew automatically until cancelled. You may cancel at any time; cancellations take effect at the end of the current billing period.
- Refund requests must be submitted within 14 days of the original charge unless a different policy is shown on the product page.
- All prices are inclusive of applicable taxes unless stated otherwise.
9. Intellectual property
- The Services, including all software, designs, assessment items, rubrics, and the “Fasgrade” brand, are owned by PT Kerja Handal Nusantara or its licensors.
- You receive a limited, non-exclusive, non-transferable license to access and use the Services under these Terms.
- By submitting Content, you grant Fasgrade a worldwide, royalty-free, non-exclusive license to host, process, display, and (where applicable) share it with reviewers and employers solely to operate the Services.
- You retain ownership of your own Content and are solely responsible for its legality and originality.
10. Third-party services & links
The Services may contain links to or integrate with third-party providers (payment processors, SSO, video, analytics). We are not responsible for third-party services and your use of them is subject to their own terms.
11. AI-assisted features
Some features use artificial intelligence to score responses, generate summaries, or recommend next steps. AI outputs are advisory; significant employment decisions remain human decisions. We minimize data shared with AI sub-processors, contractually prohibit them from using your data to train public foundation models, and provide a human-review path on request.
12. Suspension & termination
- We may suspend or terminate access at any time for breach of these Terms, court order, or security reasons.
- You may close your Account at any time via your account settings or by contacting support.
- Termination does not release you from payment obligations accrued before the termination date.
- Sections that by their nature should survive (IP, disclaimers, liability, governing law) will survive termination.
13. Disclaimer
The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Fasgrade is not a staffing agency and is not a party to any employment relationship between Participants and Employers.
14. Limitation of liability
To the maximum extent permitted by law, Fasgrade's total liability for any claim arising out of or relating to the Services is limited to the greater of (a) the amount you paid to Fasgrade in the 12 months preceding the claim, or (b) USD 100. Fasgrade will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities.
15. Indemnity
You agree to defend, indemnify, and hold harmless Fasgrade and its affiliates, officers, employees, and agents from any claim, loss, liability, cost, or expense (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your violation of any third-party right, or (c) Content you submit to the Services.
16. Force majeure
Fasgrade will not be liable for any delay or failure to perform that is caused by events outside our reasonable control, including acts of God, natural disasters, strikes, riots, power or internet outages, government actions, pandemics, or cyberattacks.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 7 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
18. Governing law & dispute resolution
These Terms are governed by the laws of the Republic of Indonesia, without regard to its conflict-of-laws principles. Any dispute will first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes will be submitted to the Central Jakarta District Court, without prejudice to our right to seek injunctive relief in any other competent jurisdiction.
19. Miscellaneous
- Severability if any provision is unenforceable, the remaining provisions continue in effect.
- Waiver failure to enforce a right does not waive it.
- Assignment you may not assign these Terms without our consent; we may assign them to an affiliate or successor in interest.
- Language these Terms are written in English; translations are provided for convenience and do not control in case of conflict.
